Last Will and Testament of Jacques E'leanor Noel Potier.

This is the last Will and Testament of me Jacques Eleanor Noel Potier of Bermondsey New Road in the County of Surrey, Cat Gut Manufacturer. First I give devise and bequeath (subject to the payment of all my just debts amongst which I now stand indebted unto my sister Rossalie Potier in the sum of about three hundred and fifty pounds and for which I request my Wife and Executrix ____ _____ here after mentioned to pay her Interest for the same after my decease at the rate of five pounds per centum per annum until the said sum shall be paid and funeral expenses and the expense of proving this my will) unto my dear and loving wife Elizabeth Melanie Potier at the time of my decease all my household furniture plate linen china pictures watches jewels rings and all ready money that I may have at the time of my decease and all debts sum and sums of money that may be then due or become due to me to and for her own sole use and benfit without being subject or liable to the control of any person or persons whomsoever together with all my implements in trade in the Cat Gut and Bullock Manufactory adloining the house No.12 wherein I now reside together with all my stock in trade in the ____ said factory or elsewhere the same may be at the time of my decease and my mind and will is that my said wife Elizabeth Melabie Potier shall be at liberty if she shall think proper so to do to carry on this said trade of Cat Gut Manufacturing to and for her own sole and separate use and benefit or to sell and dispose of the said implements in trade and the stock in trade to and for her own sole and separate use and benefit which she may think expedient to do and my mind and will is that my said wife Elizabeth Melanie Potier shall out of that part of my personal property above bequeathed to her find and provide proper mourning for such part of the family as she may think proper. I do hereby also give devise and bequeath unto my said wife Elizabeth Melanie Potier for and during the term of her natural life subject as hereafter mentioned all the rents issues and profits arising or that may arise from and out of all my leasehold property situate and being in Bermondsey New Road aforesaid or of which I may be possessed of or entitled to in any other part Great Britain at the time of my decease she paying the ground rents and keeping the houses in good and tenantable repair but my mind and will is that my said wife Elizabeth Melanie Potier shall not at any time during the term of her natural life sell assign transfer or mortgage or by any other means whatsoever raise money on or incumber any part of my said leasehold property my mind and my will being that she shall only receive the rents issues and profits to arise therefrom during the term of her natural life subject as aforesaid and I do hereby charge and make liable all my leasehold property above mentioned with the payment of one quinea per month to Ann Godso for and during the term of her natural life which is guaranteed and made payable to her by a certain Indenture bearing date the first day of May one thousand eight hundred and five and I do hereby request and direct that my said wife Elizabeth Melanie Potier do pay out of the rents and profits to be received by her from the above leasehold property the said sum of one quinea per month to the said Ann Godso as above charged on my said leasehold property and from and immediately after the dease of my said wife Elizabeth Melanie Potier I do hereby order and direct that my executors hereinafter mentioned shall with all convenient speed cause the said leasehold property to be sold by public or private sale for the most money that can be had or gotten for the same and that the money to arise from such sale I do hereby order and direct that after payment of all expenses of such sale my said executors dopay and apply the same to and among my cildren which shall be living at the time of the dease of my said wife Elizabeth Melanie Potier (except to my son Stephen Jacob Potier) or to their heirs or assigns which I hereby give devise and bequeath to them in manner following that is to say To my son Stephen Jacob Potier the sum of one shilling if he thinks proper to accept the same and as to all the rest residue and remainder of the money to and from the sale of my said leasehold property my mind and will is that the same shall be divided into seven equal parts or shares and applied in manner following that is to say. To my son Noel Peter Nicholas Potier one seventh part but subject to a deduction at the time of my decease of whatever sum of money he may stand indebted to me as will appear by a book which will be produced and wherein the sum is entered. To my son Hipolite Potier one seventh part subject to the same deduction as will appear in the said book. To my grandchildren Thomas, Elizabeth and Matilda Davis one seventh part to be equally divided amongst them if they should be living at the time of the decease of my said wife but in case of the decease of either of them before such event then to the survivor or survivors of them. And I do hereby order and direct my Executors hereinafter mentioned in case any or either of my three grandchildren should become entitled to such share or proportion before they or either of them arrive at the age of 21 years to lay out and expend the same to their or either of their use in such manner as they may think expedient for and towards their advancement in life or as may be directed by their father Thomas Davis his exors or admons but this one seventh part or share of my said leasehold property so given and bequeathed to my said three grandchildren as aforesaid is so given subject to a deduction therefrom of the sum of two hundred pounds which sum is to be taken and considered as a premium given to me for a house and butchers shop situate in Bermondsey New Road aforesaid into which I put my son in law the said Thomas Davis. To my daughter Mary Eleanor Delatter (late Potier) one seventh part subject to a deduction of five hundred pounds which her husband Joseph Delatter has already had from me. To my daughter Eulalie Hanton (late Potier) one seventh part. To my daughter Elizabeth Potier now living with me a one seventh part and to my son John Baptist Potier now living with me the one remaining seventh part. My mind and my will being that no one of my said children or their representatives should in any manner have or receive a greater sum than the other and I do hereby direct that when such sale of my leasehold property shall be made by my executors hereafter mentioned or the survivor of them or the exors admons or assigns of such survivor that the receipt or receipts of him and them respectively under his or their hand or hands will from time to time be a sufficient discharge to the purchaser or purchasers for so much of the purchase money for which such receipt shall be given and that after such receipt or receipts such purchaser or purchasers shall be absolutely discharged of and from the same and not be accountable or answerable for any loss misapplication or nonapplication of the said purchase money. Provided always and my mind and will is and I do hereby direct that my executors herein after mentioned their exors admons and assigns shall and may out of the monies that shall come to their or either of their hands by virtue of such sale as is herein before mentioned pay to him or themselves all such costs charges and expenses which he or they shall or may bear pay sustain expend or be put into for his or their care pains and trouble in about or in any wise relating to the said executorship be of this executing or performing all or any of the trusts aforesaid and that they my executors or either one of them their or either of their exors admons or assigns shall not be charged or chargeable but only each of them for his own respective receipts and payments nor with any sum or sums of money other than such as shall actually come to their or his own hands by virtue of this my will nor with any loss or damage which may happen by reason of the said executorship the execution or performance of any of the trusts hereby in them reposed without his or thier respective willful default. And I do hereby nominate constitute and appoint my said wife Elizabeth Melanie Potier, Charles Langreney and William Pugh of the Borough of Southwark in the County of Surrey, Rag Merchant, executrix and executors of this my last will and testament. And lastly I do hereby revoke and make void all former and other wills and testamentary dispositions by me at any time heretofore made and declare this only to be and contain my last will and testament. In witness whereof, I, the testaor have hereunto set my hand and seal this twenty fourth day of September in the year of our lord One Thousand Eight Hundred and Seventeen. A Codicil to be added to and taken as part of the last Will and Testament of me Jacques Eleonor Potier. Whereas in and by my said last Will and Testament I gave and bequeathed unto my dear and loving Wife Elizabeth Malanie Potier all my Leasehold Property situate and being in Bermondsey New Road in the County of Surrey or of which I might be possessed of at the time of my decease in any other part of Great Britain for and during the Term of her natural life but that my said wife should not during such her natural life sell assign transfer or mortgage or by any means whatsoever raise money on or incumber any part of my said Leasehold Property. But now my mind and will is and considering my said wife may be in want of ready money shortly after my decease that she be at liberty and I hereby give her my said wife full power and liberty to sell and dispose of ten leasehold houses situate and being in Noel Court, Bermondsey New Road aforesaid and respectively numbered 25, 26, 27, 28, 29, 30, 31, 32, 33, 34 and 35 for the best price that can be had or gotten for the same and which sum of money so to be obtained from the sale of the said ten houses I hereby give devise and bequeath uhto my dear and loving wife to and for her own sole use and benefit without being subject to the control of any person or persons whomsoever and that her receipt only shall be taken as a good and sufficient discharge to the purchaser or purchasers of the said ten houses for the same. And I hereby nominate constitute and appoint my said wife Elizabeth Melanie Potier, Charles Langreney and William Pugh, Executrix and Executors of this my Codicil to be annexed to my said last Will and Testament.

| Appeared Personally Elizabeth Melanie Potier of Bermondsey New Road in the County of Surry, widow and made oath that she is the widow and relict and one of the executrixes named in the last will and Testament of the said Jacques Eleonor Noel Potier late of Bermondsey New Road in the County of Surry deceased and saith that after the said deceased's death she found the Account book hereunto annexed marked with the letter "A" containing the accounts respecting Monies due from his children and resduary legatees named in his will and referred to in and by the Last Will and Testament of the said Book is now in all respects in the vary same plight and condition as when found by her as aforesaid save the translation annexed thereto. Last Will and Testament of Elizabeth Melanie PotierIn the Name of God Amen. To my daughter Elizabeth Ratcliffe wife of Charles Ratcliffe late of York Buildings Bermondsey (clerk) but now residing in my own house with me I give and leave all my right title and interest in the premises No 25 and No 26 in Noel Court Potier Street in the Parish of St George the Martyr County of Surry occupied by Mrs Stoner and John Cammell. To my son John B Potier also residing with me I give and will all my right title and interest in the premises No 27 and 28 in Noel Court Potier Street as aforesaid and occupied by R Boren and John Gerinell And to my daughter Eulalie Potier (alias) Hanton of Hantons Place Albany Road I give and will all my right title and interest in No 29 Noel Court Potier Street as aforesaid occupied by Mr Nicholas Potier To my daughter Elizabeth Ratcliffe I also give and bequeath a Grand Pianoforte by Gaster & Co now in the parlour Ground Floor of my dwellinghouse with the Music Stool and two Covers also two portraits thereon and three pieces of Embroidery her own work as also a Mahogany Table with a drawer and a swing box dressing glass in my own bedroom and a feather bed bolster & pillow with the bedding attached there to Mahogany Chest of Drawers on the one pr. in her own bedroom as also the whole of my personal Linen Clothes Wearing Apparel and Jewels of every description To my son John B Potier I give and bequeath a Chimney Glass in a Gilt Frame now in the pr. front room also a Swing Box Dressing Glass a Mahogany Chest of Drawers a Mahogany Dressing Table a Mahogany Night Stool with a Tent Bedstead and Furniture a Feather Bed Bolster and Pillows with the Bedding attached thereto as now in his bedroom on the first floor. The remainder and the whole of the furniture now on my premises No 12 Noel Street aforesaid not hereinbefore specified nor excepted and as pr. inventory and valuation taken by Robt Hickey on the 31st of December 1822 together with all Cat Gutt and Ox Rolls or other articles I will and Bequeath in equal parts between my said son John and daughter Elizabeth as aforesaid to be by them divided as they can best agree. It is also my desire that I may be decently interred in and that my funeral expenses together with all just debts due by me be immediately and jointly discharged and that all debts due to me be received and fairly divided between my said son John and daughter Elizabeth as also whatever money bills plate and house which may be about me or in the house at the time of my decease. I also declare this to be my last Will and Testament revoking hereby any former ones and desire my said son John and daughter Elizabeth to be joint executors hereof and in the case of death the survivor of them to be the whole and sole executor to see this my last will fulfilled for the benefit in that case of the child or children of the deceased my desire being that he she or they shall have the same interest in this bequest as the parent would have had had they lived. I hereby give devise and bequeath unto my nephew John Baptist Potire (with whom I now reside) his heirs executors administrators and assigns for ever all those five messuages or tenements with the appurtenances numbered respectively 30 31 32 33 and 34 situate and being in Noel Court Hunter Street Kent Road in the Parish of Saint George the Martyr Southwark in the County of Surry which I hold under and by virtue of a certain Indenture of Lease bearing date the seventh day of April one thousand eight hundred and twenty one and granted to me my executors administrators and assigns by Elizabeth Melanie Potier and the said John Baptist Potier for and during the term of forty nine years from the twenty fifth day of March next preceeding the date thereof. And all other my Real and Personal Estate wearing Apparel Watches Jewels Furniture and all other my Estate and Effects whatsoever and wheresoever subject to the payment of my just debts and funeral expenses.
